Scott Jensen, whose everybody-does-it-defense didn't wash with a Tommy Thompson-appointed judge (third item), is seeking to remain free during his appeal, the MJS reported on Saturday.
Having to go to the slammer -- as other lesser mortals must in these circumstances -- would "be the cause of irreparable justice. Nothing can or will ever replace the damage done to Mr. Jensen and his young family," his lawyers said in a filing.
The Brawler admires the artful response of the Dane County DA Brian Blanchard, who argues he would prevail again in a second trial:
"... the danger of irreparable justice from imprisonment is doubly low," Blanchard added.
Jensen's got a date with lockup on July 15 (the day after Bastille Day.) The wailing on the part of lying Charlie Sykes et al over the travails of St. Scott will be deafening.
But the Brawler recommends Jensen spend less time trying to stay out of the pokey and more time figuring out how to explain away his past efforts to make life a little bit harder for prisoners for the sake of looking tough on crime.
